Welcome to Rain Sounds! These Terms of Service ("Terms") govern your use of the Rain Sounds mobile application ("App") developed by Ayoub Benderdouch ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
By accessing or using Rain Sounds, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Ayoub Benderdouch.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal iOS device(s) for your personal, non-commercial use.

Rain Sounds offers premium features through auto-renewable subscription plans managed through Apple's App Store.
We offer a 7-day free trial for new subscribers. You will not be charged until the trial period ends. If you do not cancel before the trial ends, you will automatically be charged the subscription fee.

Your subscription will automatically renew at the end of each subscription period unless you cancel it. You will be charged through your Apple ID account at confirmation of purchase. Your account will be charged for renewal within 24 hours prior to the end of the current period.
Subscriptions are managed through your Apple ID account. To cancel or manage your subscription:
You may also manage subscriptions through the App Store app. Cancellation takes effect at the end of the current billing period. No refunds will be provided for the unused portion of any subscription period.
We reserve the right to modify subscription prices at any time. Price changes will not affect existing subscribers during their current subscription period. You will be notified of any price changes before they take effect.
All purchases are processed through Apple's App Store and are subject to Apple's refund policies. We do not have access to process refunds directly. To request a refund, you must contact Apple Support. Generally, refunds are not provided except as required by applicable law.
All content within the App, including but not limited to sounds, audio recordings, images, text, graphics, logos, and software, are the exclusive property of Ayoub Benderdouch or our licensors and are protected by copyright, trademark, and other intellectual property laws.
You may not:
You agree to use the App only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use of the App complies with all applicable laws and regulations.
Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the App, you consent to our collection and use of information as described in the Privacy Policy.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Rain Sounds is designed for relaxation and entertainment purposes only. It is not intended to diagnose, treat, cure, or prevent any medical condition, including but not limited to insomnia, anxiety, or sleep disorders. If you have any health concerns, please consult a qualified healthcare professional.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AYOUB BENDERDOUCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.
You agree to indemnify, defend, and hold harmless Ayoub Benderdouch and our affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:
The App may integrate with or provide access to third-party services, including Apple's App Store, Siri, and other iOS features. Your use of these third-party services is subject to their respective terms and conditions and privacy policies. We are not responsible for any third-party services.
We reserve the right to modify, suspend, or discontinue the App or any part thereof at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the App.
We may update these Terms from time to time. When we make changes, we will update the "Last Updated" date at the top of this page. We will notify you of any material changes through the App or by other means. Your continued use of the App after such changes constitutes your acceptance of the updated Terms.
We reserve the right to terminate or suspend your access to the App at any time, without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your license to use the App will immediately cease.

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction of residence, without regard to its conflict of law provisions.

The following additional terms apply to your use of the App on iOS devices:
You acknowledge that these Terms are between you and Ayoub Benderdouch only, not with Apple Inc. ("Apple"), and Apple is not responsible for the App or its content.
The license granted to you is limited to a non-transferable license to use the App on an Apple-branded product running iOS that you own or control, as permitted by the Usage Rules in the Apple App Store Terms of Service.
Apple has no obligation to provide maintenance or support services for the App. Any questions, complaints, or claims should be directed to us at ayoubbenderdouch@gmail.com.
Apple is not responsible for any warranty claims, whether express or implied. In the event of any failure to conform to warranty, you may notify Apple, and Apple will refund the purchase price (if applicable). To the maximum extent permitted by law, Apple has no other warranty obligation.
Apple is not responsible for addressing any claims relating to the App, including product liability claims, consumer protection claims, or intellectual property infringement claims.
Apple is not responsible for any third-party claim that the App infringes intellectual property rights.
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be replaced with a valid provision that most closely matches the intent of the original provision.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ayoub Benderdouch regarding the App and supersede all prior agreements and understandings.
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver of any provision will be effective only if in writing and signed by us.
You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.
